Terms of Use

These terms of use ("Agreement") set forth the general terms and conditions of your use of the "NOTA Mole Tracker" mobile application ("Mobile Application") and related “NOTA Mole Tracker” device ( "Device") and collectively referred to as the "Service". This Agreement is legally binding between you ("User", "you" or "your") and ARTES ELECTRONICS PTE. LTD ("ARTES ELECTRONICS PTE. LTD", “Company”, "we", "us" or "our"). Company under the laws of the Singapore and having its registered address at 149B TELOK AYER STREET #03 Singapore (068607).
1. Acceptance of terms
1.1 Please read this Agreement carefully. By creating an account or accessing or using the Service, you acknowledge that you accept and agree to be bound by the terms of this Agreement. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.

1.2 We may modify this Agreement from time to time. We will notify you through the App. Your continued use of the Service after the effective date of an updated version of the Agreement will indicate your acceptance of the Agreement as modified.
2. Medical services disclaimer
2.1 THE SERVICE IS NOT INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE OR DIAGNOSE, TREAT OR MANAGE ANY ILLNESS OR MEDICAL CONDITION. PLEASE CONSULT WITH A LICENSED PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH AND SAFETY OR THAT OF YOUR FAMILY. 

2.2 NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN CONNECTION WITH THE APP. ALWAYS CONSULT WITH YOUR HEALTHCARE PROFESSIONAL IF YOU HAVE ANY QUESTIONS OR CONCERNS ABOUT YOUR HEALTH OR CONDITION OR EXPERIENCE ANY CHANGES IN YOUR CONDITION OR HEALTH STATUS. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL EMERGENCY SERVICES OR GO TO THE NEAREST OPEN EMERGENCY ROOM IMMEDIATELY.

3. Registration and eligibility
3.1 To use the Service, you may be required to create or update an account (“Account”) and will be asked to provide certain personal information, which may include your name, birth date, and e-mail address and other. This information will be held and used in accordance with our privacy policy, which can be found at https://notamole.com/policy (“Privacy Policy”).

3.2 If you are under 18, your parent or guardian must review and accept the terms of this Agreement, and by using the Service, you confirm that your parent or guardian has so reviewed and accepted this Agreement.
4. The Mobile Application and Device
4.1  You agree that any content you provide on the Mobile Application  shall not: (a) be fraudulent, inaccurate or misleading; (b) infringe any third party’s proprietary rights or rights of publicity or privacy including uploading images of skin and moles that you are not allowed to upload (c) contain any viruses, Trojan horses, or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

4.2 The Service allows you to take photos of skin and moles conditions, monitor and track over the time. Inform you about the health of skin and moles, provide you with the opportunity to assess the risk profile of your skin and moles.
4.3 Full Mobile Application functionality is only available with NOTA mole tracker device
4.4 The NOTA mole tracker is a device to provide risk indication for the most common types of a specific spot on the skin based on bioimpedance. By using sensitive electrodes, device can measure tiny differences in bioimpedance in the skin and moles. As long as the cell contents are normal, service  will show a green light. When the light turns yellow or red, this indicates anomalies and/or changes in your mole.

4.5 The Mobile Application provides a recommendation whether to visit a healthcare professional for further review, continue mole tracking or not to worry about this spot.

4.6 The Mobile Application does not offer any medical advice or diagnoses. We merely facilitate a possibility to self-monitor.
5. Subscription
Our business model is based on the concept of a subscription service, which means our customers pay a fee on a regular basis (monthly or annually) to gain full access to NOTA Mole Tracker after its trial period. In case you do not buy a subscription or decide to cancel your current one, all previous scan results will be still available for viewing in your account, but new scans will be unavailable. 

5.1 Trial period
You can check if you are eligible for a trial period or numbers of days remaining on your free trial by going to Settings -> Subscription in the app, where you are automatically prompted to pair your NOTA Mole Tracker to your account. 

5.2 Check if you are eligible for a NOTA free trial 
If you purchased your NOTA Mole Tracker Device before July 14, 2022  for $320, $288, $256, $199 (with applied Ambassador discount), then you automatically get unlimited access to an unlimited number of scans for one personal account.

If you purchased your NOTA Mole Tracker Device from July 15, 2022 to September 19, 2022 for $99 (special offer price), then you get a free trial period limited to ninety (90) days from the day when NOTA Mole Tracker Device is linked to your account in the app. After a free trial expires, for further use of NOTA you need to subscribe.

If you purchased your NOTA Mole Tracker Device from  September 20, 2022 for $199, then you get a free trial period limited to three (3) days from the day when you subscribe. 
NOTE: All scan results obtained during a free trial period will be still available for viewing in your account regardless of whether you have already signed up for a paid subscription. 

5.3 Sign up for a NOTA subscription membership plan
To sign up for a NOTA subscription, select a new subscription plan with a certain payment frequency that meets your needs, click “Subscribe” and confirm the payment with a password, touch ID or face ID authorization. After signing up, your subscription is automatically tied to your NOTA App account. All payments and subscriptions are managed in your Google account or Apple ID. You get full access to NOTA Mole Tracker device till your subscription is valid and you use the same account. Your payment method corresponds to the method designated in your Google account or Apple ID.

If you signed up for a free trial or have been using your selected subscription plan within a month or a year and do not want to buy or renew your subscription after its expiration, cancel its automatic renewal in your Google account or Apple ID settings at least 24 hours before the trial ends or the end of the paid period.

If you cancel the automatic renewal of your subscription, access to the NOTA device will remain until the end of the paid period, and money for the unused period will not be returned.
6. Exclusion of Warranties and Liability
6.1. You are solely responsible for having a proper examination of your skin and moles. You accept that we do not offer advice on any possible skin and moles  condition and do not render any possible or final diagnoses. If you self-monitor your skin, you are solely responsible for uploading images at the required intervals. Any reminder service offer by us is only offered for convenience for you and should not be relied upon.

6.2  Under no circumstances will the Company be liable for any loss damage caused by a user’s reliance on information obtained through the Service. Use of this service is at the user's sole risk. 

6.3  No advice or information, whether oral or written, obtained from the Mobile Application shall create any warranty.
7.  Intellectual property rights
7.1  Intellectual Property Rights means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by ARTES ELECTRONICS PTE. LTD or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with ARTES ELECTRONICS PTE. LTD. All trademarks, service marks, graphics and logos used in connection with the Mobile Application, are trademarks or registered trademarks of ARTES ELECTRONICS PTE. LTD or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Mobile Application and Services may be the trademarks of other third parties. Your use of the Mobile Application grants you no right or license to reproduce or otherwise use any of ARTES ELECTRONICS PTE. LTD or third party trademarks.
8. Dispute resolution
8.1 The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Singapore without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Singapore. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Singapore, and you hereby submit to the personal jurisdiction of such courts.
